Goldberg to the Firm as a Member (partner) in the Labor and Employment, Employee Benefits and Executive Compensation, and Immigration Practice. He resides in the Firm's New York City office. Mr. Goldberg is an experienced Labor and Employment lawyer representing management in the full range of labor and employment matters. His practice work includes more than two dozen trials in federal and state courts, representing companies in employment discrimination, wrongful discharge, wage and hour, and restrictive covenant claims. Mr. Goldberg also regularly represents companies before the Equal Employment Opportunity Commission (EEOC), the U.S. Department of Labor Wage and Hour Division, and similar state and local labor departments and human rights agencies. He handles arbitration proceedings involving wrongful discharge, compensation, and other contractual claims by employees and former employees. In addition,
Mr. Goldberg represents non-union companies in connection with strategies to remain union-free, and unionized companies in collective bargaining negotiations, labor arbitrations, and National Labor Relations Board matters. He also counsels senior management, Boards of Directors, in-house counsel, and HR executives in connection with labor and employment issues, including discipline/discharge of employees, labor and employment aspects of mergers and acquisitions (including due diligence), restructuring, wage and hour compliance, reductions-in-force, FMLA obligations, affirmative action requirements, and workplace investigations. He also advises and negotiates with respect to employment agreements, severance agreements, and confidentiality and non-competition obligations. His legal training programs, conducted for managers, supervisors, and human resources professionals, encompass employment law issues, including employment discrimination, sexual harassment, recruiting and interviewing techniques, and best practices in the discipline and discharge of employees.
Mr. Goldberg is a graduate of Hunter College, City University of New York (B.A., 1973) and Georgetown University Law Center (J.D. 1976). He is also included in the 2009 New York City area SuperLawyers for Employment Litigation.
